These Terms and Conditions govern your use of the Website and the Inflorescence Service.
Products
1.1 All products as depicted on this Website (as may be varied from time to time) are available almost everywhere in the UK – or as otherwise directed. Certain product ranges are available in selected delivery areas only.
1.2 Certain flower and plant products may be delivered in bud to ensure longer life.
1.3 Some flower and plant products may be harmful or poisonous (lilies in particular can be extremely toxic to cats). If you require further information before submitting an order please visit our Allergy & Product Information page, or contact the Inflorescence Customer Contact Centre using the contact details set out in section 7.
1.4 All products are subject to availability. In the event of any supply difficulties, we reserve the right to substitute with a product of equivalent value and/or quality without notice. Where possible Inflorescence, may contact the customer to agree a suitable substitution.
1.5 In the event that we are unable to supply all or part of your order (the product or any substitute product to you at all), we shall notify you as soon as possible and reimburse your payment in full no later than 7 days after the intended delivery/collection date.
1.6 We are unable to offer champagne or other Finishing Touches/Added Extras with products ordered from selected ranges and locations; this will be made clear when placing your order.
1.7 Products are delivered next day unless another delivery date or delivery service is selected. See section 5 for delivery services.
1.8 Selected products are not available for same day delivery or other special delivery services. Further information regarding product availability and delivery options will be presented when placing your order.
1.9 We guarantee the freshness of your flowers for 7 days from the date of delivery/collection.
1.10 Food items may contain allergens. Please see specific product pages for allergen information. We reserve the right to substitute any items with replacements of equal or higher quality and value, In the event that a substitution is made, the nutritional and allergen summaries on our website may not reflect the true contents of the hamper.
Alcoholic Gifts
2.1 Under the Licensing Act of 1964 (UK) and 1976 (Scotland) it is an offence for any person under 18 years to buy, or attempt to buy, alcoholic liquor.
2.2 Alcoholic gifts are distributed to selected areas in association with a licensed third party. For further information regarding our suppliers contact our Customer Contact Centre, using the contact details set out in Section 7.
Prices
3.1 Prices listed within the Inflorescence Service are valid for a maximum of 14 days from the date of submitting your order.
3.2 Prices include VAT for deliveries within the UK.
3.3 Except where stated product prices exclude delivery charges.
3.5 Please note that from time to time, product and delivery prices on Inflorescence-boness.co.uk (or a subdomain of) may vary to those offered in an Inflorescence Florist or via the telephone ordering line.
3.6 Product prices are subject to change without notice.
Orders/Payments
4.1 You will be given clear instructions to navigate the order process and will be required to provide us with your complete personal details, including accurate postcode, together with those of the intended recipient and all necessary payment details.
4.2 We accept payment by all major credit and/or debit cards, other than Diners, department store cards and any other credit and/or debit cards as we may specify from time to time.
4.3 By clicking on the ‘Pay Now’ button at the end of the order process, you are consenting to be bound by our Terms and Conditions contained in these terms and conditions and appearing anywhere on the website.
4.4 Submitting your order is subject to our acceptance of this offer. We will send an email confirmation of your order details to advise that we are processing your order via the email address you provide. We will not consider ourselves bound by a contract with you until we have issued this email confirmation.
4.5 We cannot accept orders from customers under the age of eighteen (18) years.
Delivery
5.1 General Notes
5.1.1 Inflorescence do not offer delivery to areas outside their shop address
Cancellation/Amendments
6.1 If for any reason you wish to change or cancel your order you can do so, subject to clause 6.2, by calling 0333 003 3588 or emailing: customer.support@Inflorescence.co.uk. Alternatively you can cancel your order, subject to clause 6.2, by filling in the customer feedback form on our contact us page. Please give 48 hours’ notice before the requested delivery date.
6.2 We regret that you may not cancel an order for: (i) perishable goods once your order has been dispatched; or (ii) customised goods if, at the time you seek to cancel, the customisation process has begun.
6.3 In respect of non-perishable, non-customised goods you may cancel your order from the point at which you place your order until 14 calendar days after you have received your goods. If you exercise your right to cancel, you will be responsible for costs of returning the goods which must be returned within 14 calendar days of cancelling. You are not entitled to reimbursement of costs for enhanced delivery. Inflorescence has the right to deduct an amount for diminished value of goods.
6.4 In the event that goods are to be returned please return them to: Customer Services Department, Inflorescence, 101 North Street, Bo,ness EH51 9ND and you will receive a full refund, subject to clause 6.3. In the event that goods purchased from a florist need to be returned, these should be returned to the premises of the florist delivering the goods.
6.5 You are entitled to cancel any payment at any time where fraudulent use has been made of your credit or debit card by another person not acting on behalf of you or as your agent and to be re-credited by us to the extent that such sums are not reimbursed by the card issuer in such circumstances.

7.1 In the event you are not satisfied with the Inflorescence Service, please contact us and we’ll do all we can to put the situation right, or, if you prefer, give you your money back.
7.2 Because of the perishable nature of most products and in order to assist us in resolving any complaints quickly and to our mutual satisfaction, we advise you to make any complaint within 1 working day of the date of delivery or intended delivery of your purchase.

Disclaimer
9.1 Whilst we agree to use all reasonable endeavours to ensure that the Website and/or the Inflorescence Service is fully operational and error-free, we cannot guarantee this and therefore accept no responsibility for any defects and/or interruption of the Website and/or the Inflorescence Service and shall be released from our obligations under these Terms and Conditions in the event of any cause beyond our reasonable control which renders the provision of the Website and/or the Inflorescence Service impossible or impractical.
9.2 We accept liability for death or personal injury arising from our negligence.
9.3 Subject to clause 9.2 our liability in contract, tort (including negligence and breach of statutory duty) or otherwise arising by reason of or in connection with your order with us shall be limited, per claim or series of connected claims, to a multiple of 5 times the price you have paid for the products.
9.4 Subject to clauses 9.2 and 9.3 above we exclude all liability for any claims, losses, demands and damages, including without limitation, any costs, loss of profits, loss of contracts or business opportunity, loss of data and any other consequential, incidental, special or punitive damages, even if we have been advised of the possibility of such damages, arising directly or indirectly out of or in any way connected with your use or inability to access the Website and/or the Inflorescence Service, whether arising in contract, tort (including negligence), under statute or otherwise PROVIDED THAT nothing contained in these Terms and Conditions affects or will affect your or the recipient’s statutory rights in relation to the quality, fitness or description of the products supplied.
9.5 Subject to clauses 1.5 and 5.3, we shall not be liable for any delay or inability to perform our obligations to you if such delay is due to any cause whatsoever beyond our reasonable control.
9.6 Abuse of Service: We reserve the right to refuse an order if we believe your use of the Inflorescence Service, either directly or indirectly, is for any unlawful purpose, or, may cause distress or offence to any person.
9.7 Inflorescence understands that it is under a legal duty to supply goods that are in accordance with the contract.
Promotional Codes
10.1 Inflorescence promotional codes (also referred to as ‘voucher codes’) can be used against purchases made on Inflorescence.co.uk (or a subdomain of) for delivery to UK and/or Republic of Ireland and overseas. Please note we are unable to accept Inflorescence Gift Vouchers or Flora-Cheques on Inflorescence.co.uk (or a subdomain of).
10.2 Promotional codes must be entered in the relevant section of the order process on Inflorescence.co.uk (or a subdomain of). We are unable to apply a promotional code to orders already placed.
10.3 Promotional codes are usually restricted to one use per customer and should not be passed on to additional recipients.
10.4 Promotional codes may also be set to a maximum number of redemptions – if we are not able to accept the promotional code you have entered it will be because the code has expired or the maximum redemption level for promotion has been met. We will advise you accordingly in the order process and the discount will not be applied.
10.5 Selected promotional codes may be restricted for use against specified products or services – details of any restrictions will be communicated at the point where we promote the promotional code to you.
10.6 Promotional codes cannot be exchanged for a cash alternative or used in conjunction with any other promotions.
10.7 Where the promotional code entitles you to a percentage discount against the product price, this excludes any and all delivery charges.
10.8 Where the promotional code entitles you to a free delivery offer, this will usually be for Inflorescence standard delivery (next day or nominated day) charged at £7.00. Certain delivery dates may incur additional charges, such as delivery on Sunday’s or public holidays etc.
10.9 Promotional codes may be withdrawn, or suspended without notice for any reason. We will advise you within the order process if we cannot accept the promotional code you have entered.
10.10 We cannot be held responsible for non-availability of Inflorescence.co.uk (or any subdomain of) which may prevent use of promotional codes.
10.11 Changes to these terms of use may be made at any time.
10.12 Inflorescence promotional codes are not valid when purchasing Inflorescence Gift Cards, but can be used in conjunction with an Inflorescence Gift Card to make a purchase on www.Inflorescence.co.uk.
10.13 Inflorescence promotional codes are not valid when purchasing Inflorescence Gold or Inflorescence Platinum.
General
11.1 We reserve the right to supplement and amend the Terms and Conditions on which you are permitted access to the Website and/or the Inflorescence Service from time to time. We will post any changes on the Website and it is your responsibility as a customer to review the Terms and Conditions on each occasion you access the Inflorescence Service or Website. Changes will be effective five (5) hours after the posting of any such change and all subsequent dealings between you and us shall be on the new terms and conditions.
11.2 Additionally, we reserve the right to suspend, restrict or terminate access to the Website and/or the Inflorescence Services for any reason at any time.
11.3 These Terms and Conditions shall be deemed to include all other notices, policies, disclaimers and other terms contained in the Website, provided that in the event of a conflict between any such other notices, policies, disclaimers and other terms, these Terms and Conditions shall prevail. 11.7 Your purchase will be deemed to have occurred in the UK. These Terms and Conditions shall be governed by and construed in accordance with English Law and the parties agree to submit to the exclusive jurisdiction of the English courts.
Use of 03 Numbers
12.1 Calls to 03 numbers cost no more than a national rate call to either 01 or 02 numbers. This applies to calls from any type of line including mobile, BT, other fixed line or payphone. Calls from non-UK mainland locations may be higher.

15.1 The Inflorescence ‘My Account’ service (also referred to as the ‘Service’ hereafter) is provided as a complimentary feature by Inflorescence for your personal use subject to these Terms and Conditions. Except to the extent that we are required or permitted by law, any personal information which we collect will be used solely for the purposes of providing the Service.
15.2 To register with the Service you must be eighteen (18) years of age or over.
15.3 When you register with the Service you will be required to create a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities and orders that occur or are submitted under your password. If you know or suspect that someone else knows your password you should notify us immediately. Inflorescence Gift Cards
The following apply to any Inflorescence gift card (a “Gift Card” or a “Card”) purchased by you or someone on your behalf and issued by Inflorescence. By purchasing a Gift Card, accepting and retaining the Gift Card, or using the Gift Card, you agree to these terms and conditions.
16.1 Gift Cards are valid for 12 months from the date of purchase of the card. After 12 months the card will automatically expire and any remaining balance on the card will be cancelled.
16.2 Gift Cards may only be used as full or part payment for Inflorescence products in the UK shown on and purchased on our website www.Inflorescence-boness.co.uk, by telephone 01506 826992, or for such Inflorescence products. Gift Cards cannot be redeemed using any of the mobile websites.
16.3 The full amount of each purchase, including taxes and fees, will be deducted from the funds held on the Gift Card, up to the total funds available on the Gift Card. The Gift Card cannot be used to obtain cash or purchase other Gift Cards and you may not return merchandise or cancel services obtained with the Gift Card for a cash refund.
16.4 No change or refund will be given where the sales transaction is for an amount (including applicable added fees and taxes) less than the balance on the Gift Card but the remaining balance may be applied to future purchases. Gift Cards cannot be returned or refunded (subject to any rights available to you by law).
16.5 In the event of a Gift Card becoming lost or stolen, you will not be entitled to a refund, except as otherwise provided by law. Further, we are not responsible for funds on the Gift Card used without your knowledge. The Gift Card is for personal use only and may not be used for commercial purposes (including but not limited to resale) without our prior written consent.
16.6 The Gift Card is not a cheque guarantee, debit or credit card and cannot be used as one. Use of the Gift Card is limited to the amount of funds held on the Card. You cannot increase the funds on the Gift Card.
16.7 The minimum amount required to activate the Gift Card is 1p and the maximum card limit is £250. Your current balance will be displayed on your receipt or on the Gift Card itself. .
16.8 We reserve the right to supplement and/or amend these terms and conditions from time to time. We will post any changes on our Website and it is your responsibility to review the website for any changes to the Terms and Conditions. Changes will be effective five (5) hours after the posting of any such change. In the event of any change to these terms and conditions which results in the cancellation of your Gift Card or any material amendment to the scope of the Gift Card benefits, we will refund to you the outstanding balance on the Gift Card.

We shall not be liable for any injury, damage, loss or expense which may be caused or contributed by any act or omission of any such establishments or any of their agents, employees or independent contractors.
16.11 A person who is not a party to the agreement between you and us has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of the Terms and Conditions but this does not affect any right or remedy which exists apart from that act.
16.12 An Inflorescence promotional code can be used in conjunction with an Inflorescence Gift Card to make a purchase on www.Inflorescence-boness.co.uk only.

18.8 Inflorescence reserves the right to moderate content posted on its social media sites.
18.9 Any posts not in line with this Terms of Use Policy will either be deleted or not posted, as determined solely by Inflorescence, at the sole discretion of Inflorescence.
18.10 Inflorescence reserves the right to remove or report any posts which could be deemed inappropriate or offensive.
18.11 Repeated violations of this Terms of Use Policy may result in a user being banned or blocked from Inflorescence’s social media sites and reported to the appropriate social media platforms.

If you contact us about a complaint on Inflorescence’s social media sites, you will be responded to by a member of the online customer service team who will endeavour to reply to and resolve your complaint in a timely manner in accordance with Inflorescence’s Customer Services Policy.
18.18 Inflorescence has a zero tolerance approach to customers who use abusive or threatening language and will take action to protect its online customer service team including removing offensive posts and reporting the user to the appropriate social media platforms and, if deemed necessary, the police.
18.19 Between the hours of 8am and 8pm Inflorescence will always endeavour to respond to your complaint within 30 minutes of posting. Outside of these hours and during busy trading periods such as Christmas, Valentine’s Day and Mother’s Day please allow up to 4 hours for a response.
